Apartment leases are binding legal agreements. They cannot be unilaterally changed in any way. If it becomes necessary for a tenant to move out prior to the end of the lease, subleasing is possible. This means finding another person or persons, referred to as "sublessee(s)", to take over the lease. Sublessees must be screened as occurs with all tenants. The procedure is explained here.
The responsibility of finding a suitable sublessee or sublessees rests entirely with the sublessor(s), although our staff is at the ready to help guide the process. A $150.00 fee is applied for the preparation of all relevant documents. It is up to the sublessor(s) and the sublessee(s) to come with an agreement as to who will pay for this sublease fee. The security deposit and last month's rent stay on the account for the entirety of the lease. It is suggested that sublessee(s) pay sublessor(s) for these directly. Some sublessors opt to grant one or both of these sums as an incentive for finding a sublessee. This may be advisable in some situations, but ultimately is up to the sublessor(s)' discretion. The sublease is complete after Apartment Rentals staff with the participation of all parties amend the original lease accordingly. It is important to note that a sublessor is held responsible for the performance of the lease until the lease has expired.
